A contracts with B to buy a necklace , believing it is made of pearls whereas in fact it is made of imitations pearls of no value . B knows that A is mistaken and taked no steps to correct the error . Now A wants to cancel the contract on the basis of fraud . Which of the followinf statement is correct ?
a) A can cancel the contract alleging the contract
b) A cannot cancel the contract
c) A can cancel the contract alleging undue unfluence
d) A can claim damages
Its a little more complicated than that. Depending on the wording of the contract, B might have slid in something about the potential for imitation pearls.
If B did not provide the agreed upon object, they A would have defrauded the contract and the contract would be cancellable.
